Terms of Service

1. Acceptance of Terms

By enrolling a student in Kumon Bowmanville ("the Centre," "we," "us," "our") or by using our services, including in-centre classes, homework materials, assessments, digital tools, and communication channels (collectively, the "Services"), you ("you," "parent/guardian," or "student") agree to these Terms of Service (the "Terms").

If you do not agree to these Terms, you should not enroll or continue to use the Services.

2. Services Provided

We provide math and reading programs using the Kumon Method.

Services include:

  • Skills assessment and placement
  • Individualized study plans
  • Printed and/or digital worksheets
  • In-centre guidance and observation
  • Progress feedback to parents/guardians

We do not guarantee specific academic outcomes, grades, or test scores. Results vary by student effort, attendance, and consistency.

3. Enrollment and Student Information

You agree to provide accurate and complete information about the student, including contact information, allergies or relevant medical considerations, and learning needs.

You agree to update us if your contact or emergency information changes.

We reserve the right to refuse or end enrollment if we believe the program is not suitable for the student or the family is not following these Terms.

4. Fees and Payment

Monthly tuition fees are due in advance of each billing cycle.

Fees are non-refundable unless required by law.

Late payments may result in suspension of Services until payment is received.

We may adjust fees. If fees change, we will give notice before the next billing cycle.

5. Scheduling, Attendance, and Missed Classes

Your student is expected to attend on their assigned centre days and times.

If the student cannot attend, you must inform us in advance.

Missed classes are not automatically credited, refunded, or rescheduled.

We may close or move classes (for example: holidays, inclement weather, health and safety reasons). In such cases we may provide alternate timing, homework pickup, or other reasonable accommodation. We are not liable for any resulting costs to you.

6. Home Study Requirements

Kumon is a daily practice program. The student is expected to complete worksheets every day, including days they do not attend the Centre.

You agree to support the student in completing assigned work at home and returning completed work for marking.

Failure to complete assigned work may impact pace of advancement and program results.

7. Student Conduct and Safety

The student must behave respectfully toward staff and other students.

Disruptive, unsafe, or abusive behavior (verbal or physical) by a student, parent, or guardian may result in immediate suspension or termination of enrollment.

You remain responsible for drop-off and pick-up. We are not responsible for the student’s supervision outside their scheduled in-centre time.

8. Parent / Guardian Responsibilities

You agree to:

  • Ensure the student arrives prepared and on time
  • Pick up the student promptly at the end of their session
  • Review progress notes and communication from the Centre
  • Support at-home study

You acknowledge that Kumon is not childcare. You are responsible for your child before and after the assigned session window.

9. Materials and Intellectual Property

All worksheets, study plans, assessments, notes, and other program materials are owned by Kumon and/or its licensors. They are licensed to you for the enrolled student’s personal use only.

You may not copy, scan, distribute, upload, publish, sell, or reuse Kumon materials for any other student, family, school, group, or business, whether paid or unpaid.

You agree to return or destroy any physical or digital materials if enrollment ends, if requested.

10. Privacy and Communication

We collect basic student and parent information to deliver the program, track progress, and communicate with you.

We may contact you by phone, SMS/text, email, or in-app / online system regarding scheduling, performance updates, homework, billing, closures, or promotions related to Kumon Bowmanville.

We will take reasonable steps to protect student information. Absolute security cannot be guaranteed over the internet or any electronic system.

We may use anonymized, aggregated performance data (for example: average worksheet completion rates by level) for internal program improvement and reporting.

Additional privacy terms may apply under Kumon North America policies and applicable privacy law in Ontario and Canada. Those policies form part of these Terms.

11. Health and Illness

You agree not to send a student who is ill, contagious, or displaying symptoms that could create a health or safety risk for others.

We may ask a student to leave the Centre or stay home for health and safety reasons.

You acknowledge that in-person attendance carries some inherent risk of exposure to illness. You accept that risk.

12. Limitation of Liability

To the maximum extent allowed by Ontario law, Kumon Bowmanville, its owners, staff, contractors, and affiliates will not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Any lost opportunities, lost income, or lost time
  • Any claims arising from academic results, grades, test scores, admissions outcomes, or lack of improvement

Our total liability for any claim arising out of or relating to the Services is limited to the amount of fees you paid to us in the thirty (30) days before the event giving rise to the claim.

Nothing in this section limits liability where such limitation is not permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Kumon Bowmanville, its owners, staff, contractors, and affiliates from any claim, demand, loss, liability, or expense (including legal fees) arising out of:

  • Your or the student’s breach of these Terms
  • Misuse of the Services or materials
  • Conduct that causes harm to staff, other students, or property

14. Termination

You may cancel enrollment by giving written notice as required by our current cancellation policy. Fees already paid may not be refunded.

We may suspend or terminate enrollment at any time for non-payment, repeated missed work, disruptive conduct, safety concerns, or breach of these Terms.

After termination, all access to Services ends.

15. Changes to the Program or Terms

We may modify the Services, schedules, fees, policies, or these Terms at any time.

If we make a material change to these Terms, we will communicate the updated Terms. Continued enrollment after notice means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario. Any dispute will be handled in Ontario courts.

17. Severability

If any part of these Terms is found unenforceable, the remaining parts stay in effect.

18. Entire Agreement

These Terms, plus any written policies or fee schedules we provide to you, are the entire agreement between you and Kumon Bowmanville relating to the Services. They replace any earlier verbal or written understandings.
